Calls to end indefinite immigration detention, and devolve immigration

The UK is the only country in Europe that locks people up with no limit on how long they can be held.  This is despite repeated findings from UN rights committees that this policy should be changed and awareness of the devastating consequences for detainees’ mental health.

In 2018, the UK Government will publish a draft law establishing our post-Brexit immigration system.  This is an opportunity to put a time limit on immigration detention into UK law.

Meanwhile the Scottish Government has published a discussion paper setting out the ways in which the Scottish Government could be given a greater say on UK migration policy, as well as options for a Scotland-specific migration system, including:

• Scottish ministers to set specific immigration criteria
• A new Scottish body could be set up to administer the policy
• Devolved powers to make it easier for migrants’ family members, and those of UK citizens, to join them in Scotland.
