Court Reform Puts Human Rights Protections at Risk

Dr Katie Boyle, in this blog for the Civil Society Brexit Project, highlights that reforms of Judicial Review being considered by an independent review might seem small but could have potentially big impacts.

The risks range from minor technical changes that may inadvertently introduce uncertainty and a lack of clarity, to more severe implications that render the UK in breach of its international obligations. Judicial Review is a crucial accountability mechanism for violations of human rights.

Dr Boyle says: “Scotland is on the precipice of significant human rights reform…Reform to Judicial Review that impacts on the potential development of a renewed statutory framework in Scotland will undermine the efficacy of that reform.”
